Declaration of the Somalia Labour Party Establishment

LEGAL ::
History has proved that the Legal system is the most essential to the creation of a Nation that guarantees peace, justice, good governance that at the end of the day shall lead that country to progress and prosperity, which is as we know essential for the establishment of all countries and their system of government around the Globe.
Knowing that the historical concept of legal Issues had began with the first creation and existence of mankind in our World, and has gone through different historical stages from time to time, and only with continued struggle and sacrifices that mankind began to set up Rules and Regulations that contributed to the idea of legality from the very early times till today we see and witness that mankind is still demanding equality, and righteously justice through transparently acceptable legal system to all Nations and Societies.
Globally there are different Legal Systems adopted by different States and Countries but no matter their differences all are striving to serve Justice and administer it with the same aim to achieve peace and prosperity which in anyway all people around the Globe no matter what is their color, their religion, their culture and tradition all believe and trust one slogan, which is “ No Justice, No Peace” “Freedom of Liberty, Equality, brotherhood, and Unity"
The following are the Legal Policy of the Somali Labour Party:
A) The Somali Labour Party shall commit itself to the establishment of a solid and lasting Legal System that shall guarantee equality to all the Somali population in front of the Law that will be served according the Universally recognized Legal Principles that must not contradict the people’s faith, culture and good traditions.
B) The Somali Labour Party is strongly committed that through the adoption of a Just and democratically transparent Legal system shall constitute perfect tool for the re-establishment of the rule of Law in Somalia after more than two decades of anarchy and lawlessness.
C) The party shall mainly focus on the best way to train Professional Legal Authority that shall adopt transparently and serve Justice in accordance to The Rule of Law.
The Judiciary System under the guidance of The Somali Labour Party shall be established as following:
2) There will be established three Levels of Court: The District Court, The Regional Court, and The Supreme Court, all cases to be heard and decided by a joint Committee of minimum three Judges in order to avoid legal mistakes be committed by the decision of one single Justice, and all sentences are subject to appeal.
3) All Court Hearings must be Public except strictly special circumstances if so is agreed upon and decided by the Court, and in accordance of the Universally accepted Principal that says “ The accused is legally presumed innocent until proved guilty and sentenced by a Court”
4) As clearly stated in The Somali Constitution and the The Universal declaration of Human Rights the suspect must not be considered guilty before a Court sentence through transparent and precise verification of the crime through full and fair investigation results provable in front of a competent Court that must hear and decide the case.
5) The Somali Labour Party shall commit itself to provide proper knowledge and experience for all those in the Legal System administration by establishing special professional Law Schools for the training of Judges, Prosecutors, Lawyers, Legal Clarks and so forth so to equip them with all knowledge and necessary tools to administer the legal system through academic skills preparation followed by refreshment Courses and Workshops to be conducted periodically.
6) The Somali Labour Party shall commit itself to build Court Houses and or repair those existing but damaged as a consequence of the brutal and destructive Somali Civil Wars, and to implement this policy the party shall focus on the establishment of single Court House building to be shared by all three levels of Courts in every Regional Capital, this plan must be implemented during the first five years mandate of this party to govern Somalia if elected Insha Allah.
7) It is also a commitment of the Somali Labour Party to build and modernize Prison Facilities so to detain and rehabilitate legally convicted criminals guaranteeing them all rights and respects that the Somali Constitution guarantees to all Somali Citizens, help prisoners and equip them with necessary knowledge to rehabilitate them and vocational profession for their future re-integration into their Communities because according this party’s ideology prisons or detention centers must not be for punishment but for education and rehabilitation.
8) Regarding the type of governance and political aspiration and administration The Somali Labour Party shall adopt a policy of federal system of government, the “ Somali Federal Republic “, where Regional States shall have the right for full autonomy in all their administration, and run their governing business such as State, Regional, District, conduct elections freely and fairly, administer their legal system, police, municipality, education , plan, establish, and deliver all services that their population demands.
9) The Somali Federal Republic shall be formed by the union of the Somali Regional States through free and fair agreement between the Somali Federal Republic and the Regional States separately, and or jointly, the agreement must clearly contain all agreed upon Issues that shall be an obligation and or responsibility upon the parties to implement thoroughly and honestly according to the Somali Constitution and the rule of Law of The Country.
10) Its in the Party long term plan to secure positive and constructive Legal system that shall be the basis of a New Somalia with concrete political ideology based upon justice, respect, work, honor, dignity, and fully supportive for lasting mutual understanding among all Mankind, condemns all kind of aggression, violence, torture, and above all terrorism in all its aspects and actors.
10) The last but not the least The Somali Labour Party commits itself to always pray Allah The Almighty, The Creator, The Sustainer, and the Just and the Peace to help us implement our Legal Commitments so to help us become capable to save Somalia our Country, our fellow Somalis, our environment from the destruction of the prolonged Civil War, and the devastating Hell fire that they are currently in God Will, Amen.
